Moorpark Symphony Orchestra (MSO)  Member Release and Waiver of Liability

This Release and Waiver of Liability agreement by the Member releases Moorpark Symphony Orchestra, a non-profit corporation, and each of its board members. The orchestra member, guest performer, and/or conductor (hereafter referred to as "performer") by signing below indicates that he/she has read and understood the following:

 

1. Waiver and Release: The performer releases and forever discharges

and holds MSO, its successors and assigns, harmless and free from any and all liability, claims, and demands of whatever kind and nature in law or equity which arise or may hereafter arise in connection with the service the performer provides to MSO. The performer understands and acknowledges that this release discharges MSO from any liability or claims that the member may have against MSO with respect to bodily injury, personal injury, illness, death or property damage that may result from the service the performer provides for MSO or occurring in connection with the service the performer is providing.

 

2. Insurance. The performer understands that MSO does not assume any

responsibility nor obligation to provide the performer with financial or other assistance, including but not limited to medical, health or disability benefits in the event of the performer's injury, illness, death or damage to the performer's property. The performer expressly waives any such claim for compensation or liability on the part of MSO beyond what may be offered freely by MSO in the event of such injury or medical expenses incurred by the performer. The performer also releases and forever discharges MSO from any claims whatsoever which arise or may hereafter arise on account of any first-aid treatment or other medical services rendered in connection with an emergency during a MSO performance or related activities, such as rehearsal or transportation to a performance.

3. Potential risk: The performer understands that the service the performer provides may include activities that may be risky to the performer including but not limited to injury during gatherings such as performances or rehearsals.

 

4.  Photographic and/or Video Release. The performer grants and conveys to MSO al rights, title and interest in any and all photographs, images, videos or audio recordings of the performer or the performer's likeness or voice made by MSO in connection with services provided by the performer to the MSO.
